Recently we have reported on a few nursing home-related injury and negligence cases nearby, however this post deals with some shocking allegations made in a nursing home negligence case recently filed in Texas. While local laws may dictate what eventually happens in any given case, this scenario provides a good example of the types of things someone should look for in identifying nursing home abuse in North Carolina, Texas, or anywhere else.
According to the complaint filed by Wander Perkins, the daughter of the victim, Walker Beaty, employees and administrators of the Village Healthcare Center in Houston failed to provide her father with the reasonable medical care and protection he required. Consequently, that mistreatment eventually led to his death after living in the facility for only six months in 2009.
In December of 2009, Beaty was taken from the nursing home to hospital when a visitor directed a staff member to call an ambulance. Beaty was transferred to a hospital where he was diagnosed with pneumonia, dehydration, and infected bedsores. In addition, he was found to have unchewed food in his mouth and his knees were contracted so badly that he could not lie down straight on a bed. He died the following day.
Both contractures and bedsores (sometimes called pressure sores or decubitus ulcers) are common among the elderly when they are not moved periodically or when they experience long periods of inactivity. Both are signs that a resident may have been neglected for long periods of time.
The wrongful death and negligence suit filed by Perkins named CSE The Village LLC, Living Centers of Texas and SSC Harris Village LP as defendants. She alleges that the nursing home's conduct constituted medical negligence under Texas law and violated several administrative regulations aimed at protecting residents of these types of facilities. Moreover, the lawsuit alleges negligent hiring, supervision, training and employee retention on the part of the nursing home administration.
